PRIVACY INFORMATION PURSUANT TO ARTICLE 13 OF ITALIAN LEGISLATIVE DECREE NO. 196OF 30.06.2003
Article 13 of the "Italian Data Protection Act" (Legislative Decree No. 196 of 30.6.2003) sets out the requirement to inform you, as the interested party, on the main features of the processing operations, as specified in Sub-section 1, Letters a/f. We comply fully with this legislation, and to this end we hereby provide you with the following information:
All of the data collected from and disclosed by you, as the data subject, are processed exclusively to comply with requirements associated with our commercial operations, and in particular: to add your details to our IT databases; to process internal statistics; to issue estimates and offers to current and/or potential clients; to issue of offer requests to active and/or potential suppliers; for bookkeeping and VAT accounting; to comply with obligations deriving from a contract you have signed or to comply, prior to the execution of the contract, with your specific requests; to comply with legal obligations, regulations and EU rules; for customer management; for supplier management; to manage disputes.
In relation to the aforementioned purposes, the processing of your personal details is carried out using paper-based and electronic and telematic instruments, or other telecommunications systems in order to ensure the safety and confidentiality of your details, and full legal compliance. This privacy information relates to data that have been: collected directly from you (Article 13, Subsection 1); collected via third parties (Article 13, Subsection 4); sourced from public registers, lists or documents in the public domain (Article 24, Subsection 1, Letter c), within the limits and in the ways set out by the regulations on their disclosure.
NATURE OF DISCLOSURE AND CONSEQUENCES OF A REFUSAL TO RESPOND
The necessity of providing your details varies. Under certain circumstances it is compulsory to provide your details in order to comply with the law, regulations or EU rules: in these cases, if you refuse to reply it will be impossible for us to fulfil the contract; a refusal on your part will impact on the possibility of meeting effectively the contractual obligations undertaken.
The aforementioned details:
may not be disclosed;
may be communicated only to those categories of parties listed below: postal agencies or other companies responsible for the delivery of correspondence; banks and credit institutions; debt-collection agencies; law firms; insurance companies; companies responsible for maintaining/repairing IT equipment; professional firms and/or companies and/or associations of businesses and businesspeople who/that provide us with specific account and/or tax services; professional firms and/or companies and/or associations of businesses and businesspeople who/that provide us with consultancy services, etc;
may be disclosed to: employees of companies providing services; accounts and invoicing clerks; those dealing with the marketing of products/services; agent, business representatives, other commercial personnel; contract workers, temporary workers.
YOUR RIGHTS AS THE DATA SUBJECT
Pursuant to Article 7 of the Code, alongside the information set out in this statement, as the data subject you also have the right: to obtain confirmation of the existence of any of personal data concerning you, even if not yet recorded, and the communication of those data in intelligible form.
You also have the right to be informed as to:
the origin of any personal data held that concern you; the purposes and methods of the processing operations; the logic applied in the case of processing operations carried out using electronic instruments; the identification of the Data Controller, the Data Managers and the designated representative pursuant to Article 5, Subsection 2; the parties or categories of parties to whom/which the details may be disclosed or who/that may become aware of them in their capacity as local designated state representatives, managers or employees.
As the data subject, you have the right to obtain:
access to the data, and their updating, correction or (where in your interest) completion; the deletion, transformation into anonymous form or blocking of access to any data processed in breach of the law, including those for which storage is not necessary in relation to the purposes for which the data were collected or subsequently processed;
As the Data Subject, you also have the right to oppose, wholly or partially:
for legitimate reasons, the processing of your personal details, even if the processing operations are still relevant to the purpose for which the details were collected in the first place; the processing of your personal details for the purposes of sending advertising or direct sales material or for the completion of market research or commercial communications (direct marketing), including any relevant profiling operations.
To exercise the rights set out above, you may contact the data controller or one of the managers without procedural formalities, directly or via an appointed party, and an appropriate reply shall be provided in a timely fashion.
